Weslie Garner, 25, of Cullman, was arrested on Tuesday for criminally negligent homicide on a class A misdemeanor.
Garner’s one-year-old was pronounced dead in May 2012 after drowning in a bath tub. A toxicology report released in January 2013 displayed methamphetamines in Garner’s system.
Because Garner didn’t physically cause the drowning, it is not a felony.
“The reckless intent to cause the child’s death by way of the toxicology report’s findings is the reason for the misdemeanor,” Detective Joey Clark said.
Garner’s four-year-old child was removed from her home. Garner is also facing other unrelated charges. The details of how the one-year-old child drowned were not released by authorities.
Garner was released on a $6,000 bond on Wednesday morning. Her preliminary hearing’s date has not yet been released.
