COLONY —
A last-ditch effort to keep the town open failed Sunday when the council failed to field a quorum to take action.
State Sen. Paul Bussman, R-Cullman, said the voting machine at Colony will be open Tuesday. The keys to town hall were turned over to Sheriff Mike Rainey by outgoing mayor Morris Fitts.
The runoff for mayor in the town of about 270 people ended in a tie. The town council, which includes the two men tied in the mayor’s race, has deadlocked several times on deciding the issue. Time simply ran out Sunday. Only three members showed up, not enough to hold the meeting.
Bussman said state Attorney General Luther Strange believes the governor could immediately appoint another council member to the council to reach a quorum, but attorneys for the governor are uncertain that an appointment can be done until 60 days past the last Colony administration has expired.
Bussman said that issue may be worked out within the next day. He also said names are being submitted to the governor to consider for appointing a council member.
In the meantime, all town facilities at Colony are locked down and the town clerk has no authorization to pay bills or collect tax revenue.
