A preliminary hearing for an Arab man charged with the murder of a Cullman woman will be rescheduled.
The hearing for Emmett Leroy Davis was originally scheduled for 2:30 p.m. Tuesday, but District Judge Kim Chaney agreed to move the date after an attorney for the accused filed a motion for continuance.
Davis was arrested Dec. 4, 2012, in Arab for first-degree assault after Helen June Mayo, 87, of Cullman, was attacked in her home and suffered severe facial injuries. She died Jan. 6 at UAB Hospital.
A preliminary autopsy report found Mayo, who lived alone in Cullman, died from complications related to the injuries she suffered in the attack.
Davis, who was in the Cullman County Detention Center from the assault incident, was charged with murder. He remains in the detention center.
The preliminary hearing is a standard procedure in which the judge determines probable cause in the case. A new date for the hearing has not been set.
“This case has been on people’s minds. We’re hoping to get this set and send it on to the grand jury. After that, the case would be placed on the criminal docket,” said Wilson Blaylock, Cullman County district attorney.
Cullman Police Department investigators believe Mayo and other nearby residents were familiar with Davis, having previously hired him to do a variety of maintenance chores around their homes. They also believe the attack on Mayo wasn’t random, that the alleged suspect had targeted her home with an undisclosed motive.
