Deputies responded to a possible trespassing call after midnight on Tuesday to find a naked woman and a man, clad only in boxer shorts, “cuddling” and intoxicated in a ditch on County Road 421.
Nathan Fanning, 29, and Heather London, 28, both of Cullman, were arrested on separate charges, but trespassing was not one of them. The homeowner called police and reported seeing “two nude people walking away from his residence” and it was later determined that Fanning and London were possibly swimming in the homeowner’s pool without permission as they were “soaking wet,” Sheriff Mike Rainey said.
“The caller stated he thought someone was trespassing on his property and when he went outside, he saw what he thought were a naked male and female walking away from his home,” Rainey said. “When deputy Daniel Cummings arrived, he found the man and woman sitting in a ditch, cuddling each other, without any clothes on.”
Rainey said after doing a warrant check on Fanning, Cummings found the Cullman City Police Department had outstanding warrants on Fanning and he was arrested on those charges.
“As the male suspect was being arrested the female suspect became irate because of the high level of intoxication,” Rainey said. “The deputy felt she could be a danger to herself or others so she was arrested for public intoxication.”
Fanning and London were both taken to the Cullman County Detention Center. Their bonds are unavailable at this time. London was charged with public intoxication. Fanning was arrested under three failure to appear/comply/pay warrants for public intoxication, driving while license suspended and illegal possession of alcohol.
London was given a blanket for transportation to the Cullman County Detention Center and clothing from a female detention officer upon arrival. Rainey said the couple’s clothes were never recovered from the scene.
