CULLMAN —
A Cullman man was convicted of assault by a Cullman County jury this week, after allegedly striking a man with a metal tool in 2008.
Larry Wayne Fowler, 35, has been convicted of assault in the second degree, stemming from an incident on May 29, 2008.
Fowler had a dispute with another man over money, allegedly about a loan that had not been re-paid, according to District Attorney reports.
When Fowler came to the man’s home to collect the money, a fight allegedly began.
Fowler reportedly hit the other man with a crescent wrench during the fight.
The two-day trial, which was presided over by circuit court Judge Frank Brunner, ended on Tuesday with the conviction.
Assistant District Attorney Jeff Roberts said he was pleased with the verdict passed down.
“I appreciate the jury listening, because there were a lot of issues in the case,” he said. “But, it boiled down to the fact that the man used a dangerous instrument while trying to collect a debt, and the jury saw that.”
Tim Culpepper served as Fowler’s defense attorney.
Assault in the second degree is a Class C felony, punishable by up to 10 years in prison.
A sentencing date has yet to be set for the case.
