CULLMAN —
Officials with Cullman Christian School had hoped to appeal a judgment by the City of Cullman rejecting their proposed site for a new campus Tuesday in Cullman County court, though the summary judgment did not make the docket.
Court officials say they are still waiting on some additional documents to be filed, after which an official date will be set.
The private school has gone back and forth with the city since last year, when a conditional use request to build a new campus on a 39-acre plot of land on Convent Road was rejected by the city planning commission, and an appeal was rejected by the city zoning board.
City officials cited potential traffic concerns, though school officials say traffic would not be an issue. The school provided a traffic study that found the area could support the school’s potential traffic increase, though planning commission members say they still believe the increased traffic would hinder residents in the area.
The court appeal has been lingering for months, while the school board pursued other options — including a recent failed bid to have the city deannex the property.
Now, school officials say they have no option left but to follow through with a court appeal of the zoning board’s decision.
Attorneys on both sides of the case did not return messages left seeking comment Tuesday.
