Names released in Fairview shooting, investigation still ongoing

FAIRVIEW — A Fairview-area man remains hospitalized after being shot in the head Friday in an altercation local police say is still under investigation.

Charles Richard Stapleton, 45, of Cullman remained in Huntsville Hospital's intensive care unit Saturday afternoon after being transported there by helicopter Friday with a gunshot wound to his head.

His brother, 55 year-old Robert Stapleton, Jr. of Cullman, also received treatment after being shot in the torso. Cullman County sheriff Mike Rainey said Robert Stapleton was treated and released from Huntsville Hospital Friday evening.

The third party in the altercation —  Richard Lee Turney, 55, did not sustain gunshot injuries in the incident. Turney, who owns the Fairview residence where the shootings occurred, was treated for minor injuries at Cullman Regional Medical Center.

Police then transported Turney to the sheriff's office for questioning before taking him home early Saturday morning.

No charges have so far been filed against any of the men. Rainey said it appears that at least two pistols — one a .45-caliber; the other a .38 — were involved, but police do not yet know which man allegedly fired which gun.

Investigators are still trying to construct a narrative of the altercation, and will not consider pressing charges against any of the men until they have a clearer understanding of whether a crime was committed, or the alleged shooter — or shooters — acted in self defense.

"Everything is still under investigation," said Rainey. "We know there's more to it than what we were able to get from accounts last night. We're going to put our case together, and see what direction the D.A. wants to take it Monday."

At least two of the three men were allegedly involved in a physical altercation earlier in the day Friday. Rainey said the Stapleton brothers returned later in the day to Turney's residence, where reports of gunfire called police and emergency crews to the scene around 6:30 p.m.
